Overview

This website is operated by MK Supplements LLC (“MK Supplements,” “we,” “us,” “our”). By accessing our site or purchasing from us, you agree to these Terms of Service (“Terms”), our Privacy Policy, and our Return Policy (collectively, the “Agreement”).

Eligibility

You must be the age of majority where you live (or have parental consent) to use the Services and make purchases.

Health & Safety (Supplements)

Our products are dietary supplements. Information on the Site is for educational purposes only and is not medical advice. Statements have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before use, especially if pregnant/nursing, taking medication, or having a medical condition. Individual results vary.

Products, Pricing & Availability

We may limit quantities, discontinue products, or change prices at any time. We strive for accuracy but may correct errors, inaccuracies, or omissions (including after you place an order). Images are illustrative; actual packaging or formulation may vary due to improvements or supply constraints.

Orders & Acceptance

Your order is an offer to buy. We may accept or reject any order (e.g., suspected fraud, reseller activity, incomplete or inaccurate info). If we cancel or adjust an order, we will attempt to notify you using the contact details provided.

Billing & Account Information

Provide current, complete, and accurate account, billing, and shipping information. You authorize us (and our payment processors) to charge your payment method for orders and applicable taxes, shipping, and fees.

Subscriptions & Auto-Renewals (if selected)

By enrolling in a subscription, you authorize recurring charges at the stated interval until you cancel.

  • Billing cadence & price: shown at checkout and in your subscription portal; prices may change with notice.
  • Free trials/intro offers: if offered, you’ll be charged at the end of the trial unless you cancel before it ends.
  • How to cancel: cancel anytime before the next renewal cutoff via your account portal (subscription portal) or by emailing support@mksupps.com.
  • Skips/changes: skip, reschedule, or change quantities in your portal before the cutoff.
  • Failed payments: if a payment fails, we may retry and/or suspend or cancel the subscription.

Shipping, Risk of Loss & International

Title and risk of loss pass to you upon our delivery to the carrier. Delivery estimates are not guarantees. International customers are responsible for customs duties, taxes, brokerage, and import restrictions; ensure the products are legal to import to your country.

Returns & Refunds

Our Return Policy governs returns and refunds. Key points: returns accepted within 60 days; refunds exclude shipping fees; we pay return labels within the U.S.; international customers cover return shipping. See the policy for steps and exceptions (e.g., gift cards).

Promotions, Gift Cards & Referral Codes

Promotions and codes are limited-time, non-transferable, cannot be combined unless stated, and may have additional terms. We may cancel or refuse promotional orders that violate terms. Gift cards are not redeemable for cash except where required by law.

User Accounts & Security

You’re responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of unauthorized use.

User Content; Reviews & Submissions

If you post or submit reviews, photos, videos, or other content (“UGC”), you grant MK Supplements a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, modify, publish, translate, create derivative works from, distribute, and display such UGC in any media for marketing, advertising, and operational purposes. You represent you own or control the rights to your UGC and that it does not infringe others’ rights. We may moderate or remove UGC at our discretion.

SMS/Text & Email Communications (if opted in)

By providing a mobile number and opting in, you consent to receive marketing texts (e.g., updates, offers). Message & data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help. Consent not a condition of purchase. Carriers are not liable for delayed/undelivered messages. You can unsubscribe from marketing emails via the link in our emails.

Third-Party Services & Links

We use third-party platforms (e.g., Shopify, payment processors, Skio). Their terms and privacy policies apply to their services. We are not responsible for third-party websites or materials.

Intellectual Property

All content on the Site (excluding your UGC) is owned by or licensed to MK Supplements and protected by IP laws. You may not copy, distribute, or create derivative works without permission.

Acceptable Use

You may not: (a) use the Services for unlawful purposes; (b) violate others’ rights; (c) upload malware or attempt to disrupt or gain unauthorized access; (d) scrape or mine data without written consent; (e) misrepresent your identity; (f) resell or exploit the Services contrary to these Terms.

DMCA Notice

If you believe content infringes your copyright, send a notice including: (i) your signature; (ii) identification of the work; (iii) identification of the infringing material; (iv) contact info; (v) a good-faith statement; and (vi) a statement under penalty of perjury of accuracy and ownership. Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES; SOME LIMITATIONS MAY NOT APPLY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MK SUPPLEMENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS/REVENUE/DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO MK SUPPLEMENTS FOR THE PRODUCT OR SERVICE AT ISSUE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS LIMIT SUCH EXCLUSIONS; SOME LIMITATIONS MAY NOT APPLY.

Indemnification

You agree to indemnify and hold harmless MK Supplements and its affiliates, officers, employees, and agents from claims arising out of your breach of the Agreement or misuse of the Services.

Force Majeure

We are not liable for delays or failures due to events beyond our reasonable control (including supply-chain issues, acts of God, labor disputes, epidemics, carrier failures, or governmental actions).

Arbitration; Class-Action Waiver (U.S. consumers)

Except for small-claims court or where prohibited by law, any dispute between you and MK Supplements will be resolved by binding arbitration on an individual basis under the AAA Consumer Arbitration Rules. Class actions and jury trials are waived.

  • Opt-out: You may opt out within 30 days of your first purchase by emailing support@mksupps.com with subject “Arbitration Opt-Out,” your name, and the email used for your account.
  • This section is governed by the Federal Arbitration Act and remains in effect after termination.

Governing Law & Venue

Georgia law governs (without regard to conflict-of-laws). Subject to the arbitration section above, exclusive venue lies in the state or federal courts located in Fulton County, Georgia.

Electronic Communications & Notices

You consent to receive communications electronically. We may provide notices by email, posting on the Site, or your account portal. You are responsible for keeping your contact information current.

Assignment

You may not assign or transfer this Agreement without our prior written consent. We may assign to an affiliate or in connection with a merger, acquisition, or sale of assets.

Severability; Waiver; Survival

If any provision is unenforceable, it will be limited or eliminated to the minimum extent necessary, and the remainder stays in effect. Our failure to enforce a provision is not a waiver. Sections that by their nature should survive (e.g., IP, UGC license, disclaimers, limitations, indemnity, arbitration) survive termination.

Entire Agreement; Changes

This Agreement is the entire agreement between you and us regarding the Services and supersedes prior understandings. We may update these Terms; continued use after posting constitutes acceptance.
